- The licensed property management agent is contracted by the elected Directors of your Owners Management Company (OMC) and is therefore acting on behalf and under the instruction of your Directors.
- The responsibility for matters relating to maintenance, fees or the general running of your development is the responsibility of the Directors within your Owners Management Company.
- The regulations of Owners Management Companies and its directors, do not fall within the remit of the Property Services Regulatory Authority.

If you are an owner occupier within a multi-unit development and you are experiencing issues in relation to maintenance, fees or the general running of the development, you should:
- Raise your concerns with the Directors of your OMC. Note that the property management agent is not obliged to provide contact details of Board members, however their contact details can be obtained via the Companies Registration Office (CRO). You can access the CRO website accordingly: cro.ie
- If, having raised your concerns with the Directors of the OMC, you are not satisfied your issues have been adequately addressed, then under the Multi-Unit Developments Act 2011, any owner within an OMC has recourse to the Circuit Court. Should you wish to proceed in this regard, you might wish to seek independent legal advice.
Or
- If, having raised your concerns with the Directors of the OMC and they have instructed the PSRA licensed property management agent to address your issue and the agent has failed to follow their instruction, then it is open to you or the Directors of the OMC to raise a complaint with this Authority. Proof of instruction to the Agent must be included with any complaint.
Note – Your complaint cannot be considered or processed by this Authority until proof has been provided that the 2 Step Process below has been followed.
Step 1
If you are an owner within a Multi-Unit Development and are experiencing issues such as maintenance, fees or general running of your development, you must raise your concerns with the elected Board of Directors of your OMC.
Step 2
If, having raised your complaint with the Board of Directors of your Owners Management Company, you have not received a response or you are not satisfied that your issues have been adequately addressed, then under the Multi-Unit Developments Act 2011 as an owner you have recourse to the Circuit Court. You might wish to seek legal advice in this instance. A complaint should not be raised with this Authority as this Authority has no jurisdiction over Owners Management Companies.
Or
If, having raised your complaint with the Board of Directors of your Owners Management Company and they have issued instruction to the licensed property management agent to address your issue(s) and the issues continue, then you or the Board of Directors should raise a complaint with this Authority. Proof that you contacted the Board of Directors of the OMC as well a copy of the Directors’ Instruction to the Agent must be provided with the complaint.
